Please note that you access and use the Websites at your own risk. LMS is not responsible for any type of loss or damage which you may sustain as a result of accessing and using the Websites. LMS assumes no responsibility for the contents of any other Websites to which the Websites have links and if you access any such linked Websites you do so at your own risk. LMS’s inclusion of links to such websites does not imply any endorsement by LMS of the materials on such Websites. LMS does not permit any third party to operate a link to any of the Websites without obtaining LMS’s prior written consent.
The Websites are accessed via the world-wide web (“WWW”) which is independent of LMS. Your use of the WWW is at your own risk and subject to all applicable national and international laws and regulations. LMS has no responsibility for any information or services obtained by you on the WWW.

Unless LMS explicitly states otherwise in writing, you may use, view, download, copy or print textual or graphic content of the Websites provided that it is solely used by you for the purpose of carrying out your obligations to LMS under this Agreement and provided that you do not change or delete any copyright, trademark or other proprietary notices on such content.
You agree not to copy, reproduce, store in any medium (including in any other websites), distribute, transmit, modify, alter, disseminate, create derivative works from all or any part of any of the Websites or edit any part of any of the Websites other than as permitted above without obtaining LMS’s prior written consent.
Materials
You acknowledge that by posting materials on any part of any of the Websites including without limitation on any of the bulletin board sections of Websites you grant to LMS an irrevocable, perpetual, royalty free, non-exclusive, sub-licensable, worldwide right and licence to use such materials on the Websites and in any other manner LMS determines, including without limitation, copying, reproducing, modifying, adapting, editing, distributing, publishing and transmitting such materials and incorporating such materials in any other work in any other media for any purpose (including marketing purposes). You hereby waive all your moral rights in relation to such materials. If you do not wish to grant such rights to LMS it is suggested that you do not submit any materials to the Websites.
Documents
In the event that you send documents to LMS (via the Websites or otherwise) for inclusion on the Websites, you acknowledge that by doing so you grant to LMS an irrevocable, perpetual, royalty free, non-exclusive, sub-licensable, worldwide right and licence to use such materials in any manner LMS determines, including without limitation, copying, reproducing, modifying, adapting, editing, distributing, publishing, selling and transmitting such documents and incorporating such documents in any other work in any other media for any purpose. You hereby waive all your moral rights in relation to such documents. If you do not wish to grant such rights to LMS it is suggested that you do not submit any documents to LMS.
Specific Prohibitions
You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Websites nor may you attempt to decipher, de-compile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any of the Websites.
You agree to use all Websites for lawful purposes only and in a manner that does not infringe the rights of, or restrict the use of any of the Websites by, any third party. LMS does not permit any third party to in any way frame the Websites without obtaining LMS’s prior written consent.
Computer Viruses and Errors
Whilst LMS will use reasonable endeavours to ensure that the Websites do not contain or promulgate any errors, viruses, bugs, other malicious code or harmful components and will be uninterrupted, LMS makes no warranty or representation that this will be the case. It is recommended that you should virus check all materials downloaded from the Websites and regularly check for the presence of errors, viruses, bugs, other malicious code and harmful components.
Your Code of Conduct
When participating on or using the Websites (including without limitation using any of the bulletin board facilities available on certain Websites), you undertake not to: –
1. Promote or solicit any illegal activity on the Websites;
2. Transmit, post or forward any advertisements or junk mail on or to the Websites;
3. Engage in any unacceptable behaviour including without limitation using foul or obscene language, harassing, threatening, distressing, embarrassing or intimidating any other user, person or entity;
4. Transmit, post or forward any material which is unlawful, harmful, obscene, demeaning, defamatory, threatening, abusive, sensitive, harassing, vulgar, pornographic, crude, sexist, hateful or otherwise offensive to any other Website user, person or entity on any basis including without limitation on the basis of gender, race, religious affirmation or sexual preference;
5. Transmit, post or forward any material which contains viruses or other computer programming routines or engines which damage or interfere with any system, data or information;
6. Transmit, post or forward any material in which you do not own the copyright (or any other relevant intellectual property rights) or otherwise have permission to distribute electronically;
7. Transmit, post or forward any information or material that in any way infringes any intellectual property rights or any other rights of any third party nor shall you change or delete any copyright, trademark or other proprietary notice on the Websites or any content of the Websites;
8. Use the Websites in any manner that adversely affects their availability to other users;
9. Use the Websites in any manner which is contrary to applicable laws or regulations;
10. Provide LMS with any false Information (as defined in the Privacy Policy [link]); or
11. Impersonate in any manner any other Websites user or adopt an inappropriate log in name and/or password.
Bulletin Board
By using the Websites you agree that the opinions expressed in any bulletin boards within any of the Websites are the views of the person expressing them and do not necessarily reflect the views of LMS and that LMS gives no endorsement of such material.
You agree that you are personally responsible for your use of the Websites and for all your communications made in connection with the Websites. For the avoidance of doubt you are completely and solely liable for the form, content and accuracy of all materials posted on the Websites, communications and any activities of any kind conducted by or through your log-in name and password.
LMS reserves the right to discontinue your use of the Websites without notice if you use the Websites in any objectionable manner including without limitation if you breach the above code of conduct.
LMS reserves the right to monitor the contributions made by Website users to the Websites and may respond to or comment upon any communications by you and may edit, refuse to post or remove any content on or from any bulletin board on any of the Websites or on or from any documents section of any of the Websites in LMS’s absolute discretion at any time. No failure to remove any material or document or any part thereof constitutes an endorsement or acceptance of it by LMS.
LMS reserves the right to report any activity on the Websites which LMS suspects violates any relevant laws or regulations to the appropriate authority. If LMS is requested by such authority for any information about the Websites user (including without limitation the Information (as defined in the Privacy Policy [link]), information about the individual Websites users as well as names of professional staff at your practice) LMS reserves the right to disclose it to them. LMS reserves the right to reveal your identity as well as that of professional staff at your practice, even if you wish to remain anonymous.
